Terms of Service

Effective date: October 26, 2026

Agreement

These terms are between you and Gather the Family LLC (“we”, “us”), which runs Gather the Event. By creating an account, hosting a gathering, uploading to one, or texting our number, you agree to them and to our Privacy Policy. If you do not agree, please do not use the service.

The service

Gather the Event lets a host create a gathering and collect photos and videos from guests, who upload from their phones with no account. It shows new photos on a live wall, lets people tag who is in a photo, and lets the host download everything. It does not use facial recognition; see the Privacy Policy. Features and limits depend on the plan the host chose; they are listed on the pricing page.

Accounts

Hosts need an account. Give us accurate information, keep your password or passkey to yourself, and tell us promptly if you think someone else has access. You are responsible for what happens under your account. Guests do not need an account; a guest’s phone is recognised by a device token for that one gathering.

Hosts and guests

A host decides who is invited, who may see the gallery, and whether to turn on moderation, and is responsible for those choices. By default a guest sees only the photos they uploaded and the photos they are tagged in. The host may open the gallery to all guests or make it public, and may show the gathering’s photos on a live wall, which shows them to everyone in the room whatever the gallery setting.

A host is responsible for sharing the gathering’s link and code only with people who are meant to have it, for telling guests that photos are being collected and who will see them, and for having any permission the law requires from the people in their gathering. A host must remove a person’s photos or tags when that person, or a parent or guardian, reasonably asks.

A host may not use Gather the Event to send text messages to anyone, and the service does not let them: it replies by text only to a number that texted it first. Hosts invite guests themselves, for example by sharing the link, QR code or code.

Tagging people

Hosts can tag anyone in a photo, the guest who uploaded a photo can tag who is in it, and a guest can tag themselves. Every name on a photo is put there by a person; we do not identify faces. Tag only people you can really identify, and tag yourself only as yourself. Do not tag someone falsely, as a joke at their expense, or with a name that is abusive, hateful or misleading. A host can remove any tag, or all the tags one guest made, and we can too. A guest can tap “That’s not me” to remove any tag on the person linked to them, whoever made it, and can remove their tags and leave a gathering from the “You” page. A tag under a name that is not linked to you is removed by the host, or by us if you write to us.

Your content

You keep ownership of the photos, videos and messages you upload. You give us, and the host of the gathering you upload to, a licence to store, process, copy and display them as needed to run the service for that gathering: to make the gallery copies, show them to the people the host has allowed (including on a live wall), screen them for moderation, and build downloads. The licence lasts while the content is in the gathering, and a host can use the content for the purposes of the gathering, including downloading it. Only upload what you have the right to share, and only photos and videos of people when you are entitled to share them. A host who sends a gathering to Gather the Family does so by their own choice.

Acceptable use

Do not use the service to:

  • upload anything illegal, or sexual content involving minors;
  • harass, threaten or exploit anyone, or share explicit or violent content;
  • upload photos or videos of people to harm, stalk or embarrass them;
  • tag people falsely or abusively;
  • use the service to text anyone, or give out a gathering’s link or code to people who should not have it;
  • break, probe or overload the service, bypass its limits, or use it to host files that are not photos or videos from a gathering;
  • send us anything that infects or damages systems.

Photos are scanned automatically for explicit and violent content and may be held back until the host approves them. We may remove content, and suspend or close accounts, that break these terms.

Payments

Paid plans are one-time purchases for one gathering, or packs of credits; there is no subscription. Prices are on the pricing page and payments are handled by Stripe. A credit is one prepaid paid gathering, and credits do not expire. Deleting a gathering before its date refunds the purchase or returns the credit; after the date it does not. If you have another question about a charge, contact us.

A workspace that we have approved may order credits on invoice terms: the credits are added at once and Stripe sends an invoice, due within the number of days we set for that workspace. Only an owner or admin of the workspace can order this way, and only one invoice can be unpaid at a time. If an invoice is voided or written off, the credits it granted that have not been spent are withdrawn. If a paid invoice is refunded, the credits it granted that have not been spent are withdrawn too. Deleting a gathering before its date returns its credit to the workspace; it does not refund an unpaid invoice.

How long galleries last

A gathering’s gallery lasts 30 days on the free plan, 1 year on Gathering and 3 years on Gathering Plus. The host then has 30 more days of read-only access, after which the photos, videos and tags are permanently deleted. Download what you want to keep before then. Free gatherings are limited to 100 photos and no video; the limits for paid gatherings are on the pricing page.

SMS terms

  • Program name: Gather the Event guest uploads.
  • How you opt in: When our text line is active, you opt in by texting an event code to our toll-free number. Sending a code is your request for a reply. We text a number only if it texted us first, and only as a reply; hosts cannot cause us to text anyone. The text line may be limited to paid gatherings.
  • What we send: When our text line is active, one reply per code you send, with your upload link. We do not send marketing text messages.
  • Cost: Message and data rates may apply. We charge nothing for texting.
  • Opt out: Reply STOP at any time and we will not text you again, apart from one message confirming it.
  • Help: Reply HELP, or email support@gathertheevent.com, or use the contact form.
  • Carriers: Carriers are not liable for delayed or undelivered messages.
  • Consent: Consent is not a condition of any purchase. You can upload from the gathering’s web link instead.
  • Your information: see “Text messages” in the Privacy Policy. Your number is not shared for marketing, and opt-in data and consent are not shared with third parties.

Gather the Family link

A host may link a Gather the Family account and send a finished gathering to it. The link is optional and can be removed at any time. Gather the Family’s own terms and privacy policy apply to what it receives.

Availability and changes

We work to keep the service running, but we do not promise it will be uninterrupted or error-free, and we may change or retire features. If we make a change to these terms we will update this page and its effective date; using the service after that means you accept the new terms.

Ending your use

You can stop using the service at any time, and delete a gathering from the app. To close your account, email us. We may suspend or end access that breaks these terms. The parts of these terms that by their nature should continue to apply, such as the disclaimers below, do.

No warranty, and limits on our liability

The service is provided “as is” and “as available”. We do not guarantee that face detection will find every face, or that moderation will catch everything. Keep your own copies of anything precious. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the 12 months before it arose. Nothing here limits any right you have that the law does not allow us to limit.

Privacy: we count visits ourselves, with no cookies and no third-party analytics. On your first visit your browser keeps a random id for 90 days and tells us once which page you landed on, any campaign tags in the link, and which site sent you. Before storing anything we cut the page and the referring site down to their address without any query string, and we never store your IP address.
